Terms of Service

1. Acceptance of terms

By creating an account or using StalkMind, you confirm that you are at least 16 years old and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the service.

2. Description of service

StalkMind analyses publicly available social media profiles to identify potential privacy risks using AI. Audit results are provided for informational and personal security awareness purposes only. They do not constitute legal advice, professional security assessments, or guarantees of complete privacy protection. We make no warranty that the service will detect all privacy risks present in a given profile.

3. Acceptable use

You may only use StalkMind to audit:

  • Your own social media profiles
  • Profiles of individuals who have given you explicit, informed, and documented consent

You may not use StalkMind to:

  • Stalk, harass, intimidate, or surveil any person
  • Build profiles on individuals without their knowledge and consent
  • Facilitate discrimination, doxxing, or harm to any individual
  • Circumvent or attempt to circumvent any technical measures of social media platforms
  • Use the service for any unlawful purpose or in violation of any applicable laws

We reserve the right to suspend or permanently terminate accounts that violate this policy, without prior notice and without refund.

4. Intellectual property

StalkMind and its original content, features, and functionality are owned by us and protected by applicable intellectual property laws. Audit reports generated for your account are provided to you for personal use only. You may not reproduce, redistribute, or commercialise audit outputs without our prior written consent. You retain ownership of any data you submit to the service and grant us a limited licence to process it solely to deliver the service.

5. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@stalkmind.com if you suspect unauthorised access to your account. We are not liable for any loss or damage arising from your failure to maintain account security.

6. Subscriptions and billing

Paid plans (Analyst, Guardian, Sentinel) are billed through Stripe on either a monthly or annual basis, as selected at the time of purchase. Subscriptions renew automatically at the end of each billing period unless cancelled.

You may cancel your subscription at any time via the billing section of your account. Cancellation takes effect at the end of the current paid billing period; you retain access to your plan until that date. We do not offer refunds for unused portions of a billing period, except where required by applicable law.

EU/EEA consumers: If you are an EU or EEA consumer, you have a 14-day right of withdrawal from the date of your initial purchase. By requesting immediate access to the service after purchase, you acknowledge that the service will begin before the withdrawal period expires. If you exercise your right of withdrawal after the service has commenced, you will be charged a proportionate amount for the service delivered up to the date of withdrawal.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

7. Credits and scan limits

New accounts receive 10 free credits as a one-time trial allowance. These credits do not renew monthly and do not carry over to a paid plan.

Each paid plan includes a monthly credit allowance that resets on the 1st of each calendar month. Unused credits do not roll over to the following month. Credits are consumed per post analysed, as described on the pricing page.

Upon cancellation of a paid subscription, your account reverts to the Free plan. No credits from your paid plan carry over.

8. Third-party platforms and data

StalkMind only accesses data that is publicly visible on social media platforms at the time of the audit. We are not affiliated with, endorsed by, or partnered with Instagram, TikTok, or any other social media platform. Use of those platforms is exclusively governed by their own terms of service. We accept no liability for changes to platform access policies that may affect service availability.

9. Limitation of liability

StalkMind is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or reputational harm, arising from your use of or inability to use the service.

Our total cumulative liability to you for any claims arising from or related to these Terms shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) €50.

10. Indemnification

You agree to indemnify, defend, and hold harmless StalkMind and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your violation of these Terms, your misuse of the service, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. You may delete your account at any time from your profile settings; this permanently and irreversibly removes all your data from our systems within 30 days. Upon termination for cause, no refund will be issued for any unused portion of your subscription.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. Any dispute arising from these Terms shall first be submitted to good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Portugal, except where mandatory consumer protection laws in your country of residence grant you the right to bring proceedings in local courts.

13. Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, internet outages, third-party service failures, or changes in platform access policies by social media companies.

14. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you may delete your account before they take effect.
